NETEO  – TERMS OF SERVICE  

Effective Date: April 15, 2025
These Terms of Service (“Terms”), together with our Privacy Policy, Open Internet Policy, and DMCA Copyright Process, form a legally binding agreement between you (“Subscriber”) and Wi-Fiber of Colorado, LLC dba NETEO (“NETEO,” “Company,” “we,” or “us”). By using our Services, you agree to comply with these Terms and all incorporated policies.OVERVIEW OF TERMS
1.1 Scope of Services
These Terms apply to all Internet Access Services (IAS), VoIP services, and related data and wireline services provided to residential and commercial subscribers.
1.2 Updates to Terms
NETEO may update these Terms and any incorporated policies periodically. Subscribers will be notified of material changes. Current versions are available upon request or via our website.
1.3 Dispute Resolution & Arbitration
By agreeing to these Terms, you waive your rights to a jury trial or class action, and any disputes must be resolved through arbitration as detailed in Section 16.
1.4 Eligibility
Subscribers must be of legal age and authorized to enter into binding agreements. Commercial subscribers must ensure signers have authority to bind the organization.

PROTECTION PLAN
NETEO offers an optional Protection Plan providing coverage for subscriber-caused issues.
Included Benefits:

Unlimited annual service calls for:

Subscriber device damage

Weather-related damage

Equipment relocation
Limitations & Conditions:

Service calls are limited to 2 hours; additional time is billed at standard rates.

Tasks such as running new wiring are billed on a Time & Materials (T&M) basis.

Excessive or abusive use may result in cancellation of the plan.

Subscribers may opt out at any time by contacting NETEO.

SERVICE TERM

Residential and Commercial IAS: Month-to-month.

VoIP, Wi-Fi, or other services: Terms provided before activation.

PAYMENTS & FEES

Invoices: Due upon receipt.

Credit Review: Service may be denied or terminated based on credit history.

Deposits & Install Fees: May apply depending on location and complexity.

Billing: Invoices are emailed (mailed invoices incur a $3 fee).

Accepted Payments: Cash, check, credit card, ACH.

Late Payments: Over 30 days past due may trigger suspension and reactivation fees.

Returned Payments: $25 fee for returned checks/ACH.

Taxes/Fees: Subscriber is responsible for all applicable taxes and government fees.

EQUIPMENT AND SERVICE REQUIREMENTS
5.1 Subscriber Equipment
The Subscriber is responsible for providing and maintaining their own devices. NETEO may, at its discretion, assist with equipment updates but is not obligated to maintain or repair third-party equipment. Subscriber equipment must not damage NETEO equipment or networks, and Subscribers agree not to alter or tamper with Company equipment.
5.2 Company Equipment
Company equipment remains the property of NETEO and may include refurbished items. Upon service termination, equipment must be returned within 15 days. Failure to return, or returning damaged or lost equipment, may result in replacement charges determined by NETEO.
5.3 Access to Subscriber’s Premises
Subscriber grants NETEO and its contractors reasonable access to premises to install, maintain, or retrieve Company equipment, with notice provided except in emergencies.
5.4 Service Level
In the event of service outages lasting more than 24 consecutive hours due to Company issues, Subscribers may request a prorated credit. NETEO may use network management tools to enhance network efficiency and may correct pricing or service description errors.

SUBSCRIBER OBLIGATIONS
6.1 Use Restrictions
Subscribers may not transfer, resell, or sublicense the Service. For residential accounts, use is limited to the immediate household; for commercial accounts, use is limited to authorized employees at the service address.
6.2 Account Responsibility
Subscribers are responsible for any use of the Service, including by others using their equipment or account. Subscribers must maintain power to Company equipment; damage from loss of power is the Subscriber’s responsibility.
6.3 Security and Maintenance
Subscribers must use and maintain antivirus, firewall, and system updates on their equipment. NETEO is not liable for damages arising from a lack of these protections.
6.4 Resale and Competition
Resale of the Service or use of the Service to compete with NETEO is prohibited without a specific written reseller agreement.
6.5 Data Backup
Subscribers are responsible for backing up their data. NETEO is not responsible for any data loss.
6.6 IP Addresses
Subscribers do not own any IP address assigned by NETEO. IP addresses may change or be reassigned at NETEO’s discretion.
6.7 Equipment Protection
Subscribers bear the risk for any damage to Company-provided equipment while in their possession, including damage from theft or natural events.

SUBSCRIBER REPRESENTATIONS AND WARRANTIES
7.1 Accuracy of Information
Subscriber agrees that all personal and payment information (“Subscriber Information”) provided to NETEO is accurate and up to date. Subscribers must promptly update any changes.
7.2 Permissible Use
Subscriber agrees not to use the Service to infringe third-party rights, violate laws, or transmit harmful or offensive content. Impersonation, unauthorized access, and virus transmission are prohibited.
7.3 Installation Compliance
Subscriber is responsible for ensuring that installation of Company equipment complies with local codes, homeowner association rules, and other applicable regulations. Any fines or penalties are the Subscriber’s responsibility.
7.4 Speed Packages
Subscriber understands that all packages are “up to” speeds. Actual speeds may vary based on package, location, distance, technology, terrain, and network conditions.

SUBSCRIBER MATERIAL AND CONTENT
8.1 Investigation of Violations
NETEO may investigate potential violations of these Terms and may review Subscriber material stored on Company servers if necessary. NETEO may suspend accounts or remove material during investigations and may take further actions if violations are confirmed.
8.2 Content Responsibility
Subscribers are solely responsible for the legality of their content. Unlawful storage or distribution of content may result in civil and criminal liability.
8.3 Content Removal
NETEO may remove or disable access to content that infringes copyright when properly notified under the DMCA.
8.4 Content Upon Termination
Upon termination of Service, NETEO may delete all Subscriber materials, including websites, email, and stored files.

ACCEPTABLE USE POLICY
9.1 Permitted Activities
Acceptable use includes typical Internet activities such as web browsing, email, messaging, streaming, and limited personal web hosting, consistent with the account type and applicable policies.
9.2 Prohibited Activities
Prohibited activities include, but are not limited to:

Running unauthorized background/server applications (except smart home/IoT devices).

Long-term storage of rarely used files.

Abusive activities such as ICMP flooding or phishing.

Attempted security compromises, hacking, or unauthorized access.

Account sharing to avoid payment.

Excessive system resource use, port scanning, or prohibited business use on residential accounts.

Unauthorized email or USENET abuse, including spamming and harassment.

Illegal schemes, pirated software, high-traffic websites impacting network performance, and unlawful content such as threats or unlicensed material.
Violation of this policy may result in account restriction, suspension, or termination and may carry legal consequences.

SUBSCRIBER SECURITY AND PASSWORDS
NETEO may require Subscribers to use usernames, passwords, or other verification methods to access account information and make changes.

Individual Subscribers: Accounts are for personal use only; passwords should not be shared.

Commercial Subscribers: Only authorized personnel should have access to passwords.
NETEO may issue or reset passwords when account security is compromised. Repeated security issues may result in account termination.
Subscribers are responsible for the security of their devices, data, and account credentials. NETEO recommends the use of antivirus, anti-spyware, firewalls, and data encryption where feasible. Subscribers may not use the Service to compromise security or tamper with NETEO’s networks or equipment.

TERMINATION
NETEO may terminate or suspend access to Services at any time, without notice, if it believes that Subscriber has breached these Terms. Operational service providers that support NETEO’s Services may also have access to Subscriber accounts.
Subscriber Termination Rights:

Subscribers must provide 30 days’ notice to cancel Service.

No refunds will be issued for the month in which Service is cancelled, unless required by law.

Upon termination, Subscriber must return Company equipment within 15 days or pay the Equipment Replacement Price.

NETEO may terminate Services for unpaid balances, harassment of Company personnel, or violation of these Terms.

DISCLAIMER OF WARRANTIES
SUBSCRIBER AGREES THAT USE OF THE SERVICES AND COMPANY EQUIPMENT IS AT THEIR SOLE RISK. THE SERVICE AND EQUIPMENT ARE PROVIDED “AS-IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. NETEO DOES NOT WARRANT:

Uninterrupted, timely, or secure use of the Service;

That the Service will meet Subscriber requirements;

That the Service will be error-free or free from harmful components;

The security of Subscriber data or prevention of unauthorized access.
NETEO is not responsible for damage to Subscriber systems or data. NETEO does not guarantee specific bandwidth or speeds, as numerous factors influence performance.

LIMITATION OF LIABILITY
To the fullest extent allowed by law:

NETEO and associated entities are not liable for indirect, incidental, or consequential damages.

NETEO’s maximum liability for any claim is $100.

NETEO is not liable for:

Third-party fees or incidental charges;

Data loss or security breaches;

Circumstances beyond its control;

Interference or incompatibility with non-voice systems, or actions of other carriers;

Subscriber’s use of Service for high-risk activities.
This limitation survives termination of these Terms.

AGREEMENT TO ARBITRATE
Subscriber and NETEO agree to resolve all disputes through arbitration. By agreeing to these Terms, Subscriber waives the right to a jury trial or class action.

Arbitration will follow AAA Rules and take place in Colorado, unless otherwise agreed.

Prior to arbitration, the initiating party must send written notice describing the dispute and desired resolution. If no agreement is reached within 60 days, arbitration may commence.

Arbitrators may only award relief to individual parties; class or representative actions are prohibited without mutual consent.

Subscriber may reject future changes to this arbitration clause by notifying NETEO in writing within 30 days of the change.

INDEMNIFICATION
Subscriber agrees to indemnify, defend, and hold harmless NETEO, its affiliates, and licensors (collectively, “Company Indemnitees”) from all losses, damages, and claims (including legal fees) arising from Subscriber’s use of the Service, breach of these Terms, or infringement of third-party rights.

GENERAL PROVISIONS

Entire Agreement: These Terms and incorporated policies constitute the entire agreement between Subscriber and NETEO.

Third-Party Beneficiaries: Affiliates and licensors of NETEO are intended beneficiaries of these Terms.

No Agency: These Terms do not create a partnership, joint venture, or agency relationship.

Force Majeure: NETEO is not liable for failure to perform due to circumstances beyond its control.

No Waiver: Failure to enforce any provision does not waive it.

Severability: If any provision is found invalid, remaining provisions remain in effect.

Amendments: NETEO may modify these Terms by posting changes or providing notice. Continued use of the Service implies acceptance.

Notices: To Subscriber by email, mail, or website posting; to NETEO by first-class mail to the designated Company address.

Assignment: Subscriber may not assign these Terms without consent. NETEO may assign its rights without notice.

Survival: Sections intended to survive termination, including limitation of liability and indemnification, remain in effect after termination.

This Privacy Policy describes how Wi-Fiber of Colorado, LLC dba NETEO  (“NETEO,” “Company,” “we,” or “us”) collects, uses, discloses, and protects information associated with our subscribers. This Policy applies to all Internet Access Services (“IAS”), VoIP services, and related products offered by NETEO.
By using our Services, you consent to the practices described in this Privacy Policy.INFORMATION WE COLLECT
NETEO collects the following categories of information:

Information provided by subscribers during account creation or service installation, including:

1.2 Customer Proprietary Network Information (CPNI)
As defined by federal law, CPNI includes:

Technical configuration

Equipment details
NETEO protects CPNI and does not share it without customer approval unless required by law.
1.3 Network & Device Information
We collect technical information needed to provide and maintain service, including:

IP addresses

MAC addresses

Device connection times

Signal strength & radio diagnostics (for wireless customers)

Network performance data

Bandwidth usage
1.4 Cookies & Website Data
When users visit neteo.co or related domains, we may collect:

Log data

Cookie identifiers

Browser information

Website usage analytics
1.5 Payment & Transaction Records
We maintain records of billing, invoices, payment methods, and account history.

HOW WE USE YOUR INFORMATION
We use subscriber information for the following purposes:

2.4 Marketing & Communication (Limited)
NETEO may send service updates, promotions, or system alerts. Customers may opt out of non-essential marketing.

DISCLOSURE OF INFORMATION
NETEO does not sell subscriber information to third parties.
We may share information only under the following circumstances:
3.1 Operational Service Providers
Trusted vendors who assist in billing, support, or technical operations. They must keep information confidential.
3.2 Law Enforcement
Only when legally required and after validating the request.
3.3 Business Transfers
If NETEO is acquired or merged, subscriber information may transfer with the business.

CUSTOMER RIGHTS
Subscribers have the right to:

Request a copy of data we hold

Update or correct account information

Request that marketing communications stop

Request CPNI usage restrictions

File disputes regarding improper disclosures

No system can guarantee 100% security, but NETEO implements reasonable measures to protect subscriber information.

CHILDREN’S PRIVACY
NETEO does not knowingly collect information from children under age 13. Our service is intended for adult account holders only.

CHANGES TO THIS POLICY
NETEO may update this Privacy Policy at any time. Subscribers will be notified of significant changes.

HOW TO FILE A DMCA TAKEDOWN NOTICE
If you believe your copyrighted content is being used unlawfully by a NETEO subscriber, you may submit a takedown request to our Copyright Agent.
Your DMCA notice must include:

Identification of the copyrighted work claimed to have been infringed.

Identification of the material claimed to be infringing (including URLs, timestamps, file names, or other identifying data).

Your name, address, telephone number, and email.

A statement that you have a good faith belief that the use is not authorized.

A statement under penalty of perjury that the information in the notice is accurate.

Your physical or electronic signature.
Incomplete notices may be rejected.

WHAT NETEO DOES WHEN WE RECEIVE A DMCA NOTICE
Upon receiving a valid claim:

We will notify the subscriber associated with the alleged activity.

We may temporarily disable or limit access to the material in question.

We may suspend the subscriber’s service if required by law or policy.

We will notify the subscriber of their right to submit a counter-notification.
NETEO does not monitor traffic or subscriber activity proactively.

HOW TO FILE A COUNTER-NOTIFICATION
If you believe your content was mistakenly removed or restricted, you may file a counter-notification including:

Identification of the material removed or disabled.

A statement under penalty of perjury that you believe the removal was due to mistake or misidentification.

Your name, address, and phone number.

Consent to the jurisdiction of the federal district court where your residence is located.

Your physical or electronic signature.
Upon receiving a valid counter-notice, NETEO may restore the content unless the complainant files a court action within 14 business days.

REPEAT INFRINGER POLICY
NETEO may terminate the accounts of subscribers who repeatedly infringe copyrights.
A “repeat infringer” is defined as:

Any subscriber who receives multiple DMCA notices within a reasonable period; or

Any subscriber who engages in a documented pattern of copyright infringement.
Upon termination, the subscriber remains responsible for all outstanding balances and equipment return requirements.

MISUSE OF DMCA PROCESS
Submitting false DMCA notices or false counter-notifications may result in civil or criminal penalties.

NETEO  (“NETEO,” “Company,” “we,” or “us”) is committed to providing an open, reliable, and high-quality Internet experience to all subscribers. This Open Internet Policy (“Policy”) describes our network practices, performance expectations, and commercial terms in compliance with applicable federal guidelines, including the FCC’s Open Internet principles. This Policy applies to all Internet Access Services (“IAS”) offered by NETEO, regardless of technology (fiber, fixed wireless, hybrid, or other). This Policy is incorporated by reference into our Terms of Service and is subject to periodic updates.NO BLOCKING
NETEO does not block lawful content, applications, services, or non-harmful devices. Subscribers are free to access any lawful website, platform, application, or online service of their choice.

NO THROTTLING
NETEO does not throttle, degrade, or impair lawful Internet traffic based on:

Content

Application

Service

Device

Source or destination
Traffic may be temporarily slowed only under reasonable network management practices (see Section 7).

NO PAID PRIORITIZATION
NETEO does not engage in:

Paid prioritization

“Fast lanes”

Favoring traffic of affiliates

Prioritizing any Internet content or service in exchange for consideration
All customers and all lawful content receive equal access to the network.

DEVICE & SERVICE COMPATIBILITY
NETEO permits customers to attach any non-harmful, compatible device to the network, including:

Routers

Switches

Wi-Fi systems

Smart home or IoT devices
NETEO may block devices only if they:

Cause network harm

Create security risks

Interfere with Company equipment
Customers using third-party devices are responsible for their configuration and support.

NETWORK PERFORMANCE & SPEEDS
All Internet packages are advertised as “up to” speeds. Actual performance may vary based on:

Network congestion

Terrain and wireless signal quality (for fixed wireless)

Customer equipment

Building materials and internal wiring

Distance from distribution equipment
NETEO strives to ensure customers receive speeds that match service tier expectations during normal network conditions.
Latency typically ranges:

Fiber/fiber-fed: 5–20 ms

Fixed wireless: 15–40 ms (terrain-dependent)
These figures represent common experiences but are not guaranteed.

COMMERCIAL TERMS
Full details regarding billing, early termination, installation costs, and service terms are located in our Terms of Service and Privacy Policy.
NETEO does not:

Charge extra for access to lawful content

Impose usage-based billing or data caps (unless explicitly stated for specific plans)

Require modem rentals unless part of a package
Subscribers remain responsible for maintaining functional internal networks, routers, and home devices.

REASONABLE NETWORK MANAGEMENT
NETEO employs reasonable network management practices designed to optimize performance and protect the network, including:

7.1 Congestion Management
NETEO prioritizes traffic equally and does not discriminate by type. During periods of unusually high congestion, the network may temporarily slow traffic in a protocol-agnostic, content-neutral manner.7.2 Security & Integrity Protections
NETEO may:Block malicious traffic

Prevent denial-of-service attacks

Limit traffic from compromised devices

Suspend service temporarily to protect the network from harm
These measures are not targeted at lawful use and are applied only as necessary.

7.3 Equipment & Configuration Updates
NETEO may remotely update equipment firmware, apply patches, or perform maintenance to ensure security and performance.APPLICATION-SPECIFIC BEHAVIOR
NETEO does not block or throttle specific applications such as:

VPNs

VoIP

Streaming services

Gaming services

Cloud platforms
Some applications may perform differently depending on bandwidth, latency, or customer equipment.

PRIVACY
NETEO does not monitor customer traffic except as required to:

Protect the network

Bill for service

Comply with law enforcement requests

Manage network operations
Customer information is handled in accordance with our Privacy Policy.

VIOLATION OF POLICY
This Policy does not alter or supersede the NETEO Terms of Service. Violations of the Terms—including illegal activity, network abuse, or harm to Company equipment—may result in suspension or termination of service.
